Entering the professional music market – Q&A

Working as a (freelance) musician

Employees:

  • have an employment contract or service contract with the employer.
  • must follow their employer’s instructions regarding the time, duration, place and nature of work and are integrated into the employer’s operational processes.
  • get a income tax card, are insured and the employer pays just under half of the costs for health insurance, pension insurance, unemployment insurance etc.
  • if they are on sick leave, they generally continue to receive wages, and if they are unemployed, they receive unemployment benefits.

Self-employed:

  • do not have an employment contract/service contract with an employer, but e.g. a contract for work with a client.
  • independently organise their activity and working hours and can determine when, where and how they work.
  • bear the entrepreneurial risk.
  • have to pay health insurance separately.
  • Caution: if a self-employed musician works primarily for one client only, this can lead to so-called „pseudo self-employment“ (“Scheinselbständigkeit”) – this can result in high additional payments for the client (and sometimes also for the self-employed musician).

In Germany, self-employment is divided into two types: “Freie Berufe” (freelance professions) and “Gewerbe” (trade). Different rules apply for these categories.

Freelancers are self-employed professionals with special qualifications. They have „income from self-employment“ and don’t have to pay trade tax (“Gewerbesteuer”). In addition, they have to observe fewer formalities (e.g. bookkeeping). They only have to register their self-employment with the tax office and apply for a tax number. However, not everyone can work as a freelancer – you have to belong to the „liberal professions“ [“freie Berufe”], e.g. law and tax professionals, writers and artists, medical professionals, teachers, engineers and architects. This is often the case with musicians or self-employed music teachers. In case of doubt, the tax office (“Finanzamt”) or a tax advisor can help with clarification.

 

If you are self-employed, but not a freelancer (Freiberufler), you are a tradesperson (“Gewerbetreibender”). If your business is a trade, you must pay trade tax (Gewerbesteuer). In addition, you have to register with the Trade Licensing Office (“Gewerbeamt”), pay membership fees to the Chamber of Industry and Commerce (“IHK”) and observe other formalities such as double-entry bookkeeping.

In order to set up a company together, you have to agree on a legal form.  The most simple form is to set up a civil law partnership [Gesellschaft bürgerlichen Rechts (GbR)] – a simple association between several people. If you want to limit liability, you can also set up a „UG“ or a „GmbH“ – but this leads to considerably more formalities.

  • Yes, you can be self-employed and at the same time work as an employee. However, you have to make sure that you do not violate any conditions in your employment contract, e.g. that you do not compete with your employer and that you do not work too many hours a week. It is best to get permission for self-employment from your employer beforehand. If you earn more in self-employment than in employment, this can trigger changes in social insurance and you have to inform the tax office.

You can teach either privately or at a public or private music school. At music schools, you can work either as an employee or as a freelancer. However, jobs with an employment contract are rare.

Bookkeeping and Taxes

In Germany, certain formalities must be observed when issuing invoices so that there is no trouble with the tax office or the client. An invoice must contain the following information:

  • Your own address and the address of the invoice recipient
  • Your own tax number and/or identification number
  • A consecutive invoice number
  • Type and scope of the service
  • Date or period of service (e.g. day of the event)
  • The invoice amount (net)
  • Indication of the tax rate and the amount of the tax
  • Your own account number
  • Payment deadline

Yes, as soon as your income or profit exceeds a certain limit (2023: 10,908 euros), you have to pay income tax in Germany. You have to pay tax on the income or profit that exceeds this limit.

 

If you are self-employed as a musician and earn income, you always have to file an income tax return. But even as an employed musician, it can be worthwhile to file a tax return.

If you charge value added tax (VAT) as a self-employed musician, then you must also regularly submit a VAT return.

Kreativ Kultur Berlin

Kreativ Kultur Berlin is Berlin’s first point of contact for Berlin’s artists and cultural practitioners who are looking for information on funding programs. Kreativ Kultur Berlin offers free-of-charge consultations that provide basic orientation for project funding. Their service addresses all cultural workers wanting to realize a project in Berlin – regardless of project size or ownership. The website offers an extensive database with information on possible foundations and programs. Kreativ Kultur Berlin also organizes regular events, expert talks, workshops and networking events. All events are free of charge.

The German Music Information Center /Deutsches Musikinformationszentrum

Senate Department for Culture and Europe

The City of Berlin supports music projects and provides grants in the form of project funding and stipends to artists based in Berlin. It also provided funding for  intercultural music projects and international cultural exchanges.

Music Board

The Berlin Senate set up the Music Board in 2013  with the aim of strengthening the local pop music scene by supporting projects of national and international scope. The Musicboard Berlin aims to fund pop music in new and creative ways and maintain a dynamic discourse on pop music in Berlin.

initiative neue musik berlin e.v.

The initiative neue musik berlin e.V. (inm) annually awards project funding from the state of Berlin for independent groups in the field of contemporary music. The members of inm elect an independent jury for two years at a time, which – subject to a decision on the respective budget of the state of Berlin – decides on the distribution of funds for project funding. The focus of the funding activities is on supporting innovative event formats and their organisation.

Creative Service Center der WeTek gGmbH

The Creative Service Center of WeTeK Berlin gGmbH has a new certificate course on offer for freelance musicians interested in music education: „Musicpaed – fit für die Musikvermittlung“.

The course prepares musicians for work in music education projects, supports musicians in making the best possible use of their musical skills in creative workshops with different people and provides insights into the educational work of various organisations. The start date is flexible.

Alle Berliner Amateurmusiker:innen sind herzlich eingeladen, an der Offenen Probe am Samstagabend teilzunehmen. 

Exklusiv für den Orchestertreff werden der zweite und vierte Satz der 7. Sinfonie von Ludwig van Beethoven so arrangiert, dass auch Musiker:innen mit unterschiedlichen Zupfinstrumenten, Akkordeon und anderen im Original nicht besetzten Instrumenten mitspielen können. 

Es ist erwünscht, dass die Teilnehmer:innen Ensemble-Erfahrung mitbringen. 

Iván Fischer

ist Ehrendirigent des Konzerthausorchesters und als einer der visionärsten Musiker unserer Zeit bekannt.

Er war Chefdirigent des National Symphony Orchestras in Washington, Opéra National de Lyon und des Konzerthausorchesters Berlin, letzteres hat ihn zum Ehrendirigent ernannt. Ebenso ist er Honorary Guest Conductor des Royal Concertgebouw Orchestra, mit dem ihn eine jahrzehntelange Zusammenarbeit verbindet.  

Bei den Berliner Philharmonikern, dem Symphonieorchester des BR und dem New York Philharmonic Orchestra ist er regelmäßig zu Gast.

Nach einigen Gastauftritten in internationalen Opernhäusern, entschied er sich auch bei der Oper für einen Reformweg und gründete die Ivan Fischer Opera Company, mit der er unabhängige Opernproduktionen verwirklicht. Seit 2004 ist Iván Fischer auch als Komponist tätig, er schreibt meist vokale Musik mit kleinen Instrumentalensembles. 

Iván Fischer wurde 2013 zum Ehrenmitglied der Royal Academy of Music in London ernannt und ist Ehrenbürger von Budapest.
